Welcome to LocalTravelStay. By using this
platform, you agree to the following legally binding terms:
1. Nature of Service (Pure Intermediary)
LocalTravelStay is a listing platform (aggregator) that connects customers with
independent vendors for rooms, car rentals, bike rentals, and restaurants.
Legal Status: This platform is an ‘Intermediary’ under Section
79 of the Information Technology Act, 2000. We do not own, manage, or provide any
of the services listed. We are strictly a digital notice board.
2. Direct Dealing & Liability
- Direct Interaction: All bookings, payments, and negotiations happen
directly between the customer and the vendor. The platform is NOT a party to these
transactions.
- No Guarantee: We do not guarantee the quality, safety, or condition of the
services (e.g., room cleanliness, vehicle condition, or food quality).
3. Identity & Safety (KYC)
Verification: Users are advised to verify the Government ID (Aadhar, Driving
License, etc.) of the vendor/driver/hotel staff before engaging. The platform does not conduct
criminal background checks on vendors or users. Use services at your own risk.
4. Incident Reporting & Legal Disputes
Misbehavior/Incidents: In case of any criminal activity, harassment,
misbehavior, or physical harm, the platform is NOT liable.
The aggrieved party must approach the local police authorities directly. We will provide data
logs/records only if formally requested by legal authorities through a valid warrant or notice.
5. Zero Tolerance Policy
We maintain a Zero Tolerance Policy for misconduct. If a vendor or customer is
found guilty of fraud, misbehavior, or providing false information, we reserve the right to
Permanently Ban their account without prior notice.
6. Specific Service Rules
- Family Only: Certain listings (especially in Mathura/Vrindavan) are
strictly for families. Vendors have the right to deny check-in to single persons.
- Amenities: Amenities like 'Cooler', 'Wi-Fi', etc., are provided by the
vendor. No compensation can be claimed from the platform for deficiencies.
- Check-out: Standard check-out is 10:00 AM unless otherwise agreed with the
vendor.
7. Limitation of Liability
LocalTravelStay shall not be held responsible for any loss, damage, accident, theft, or injury
arising from the use of services listed. Users agree to indemnify the platform against all such
claims.
